A COVID–19-járvány európai uniós kezelése a „hatáskörök hálója” avagy a rejtett hatáskörök révén

A szerző célja az volt a cikk megírásával, hogy megvizsgálja miként kezelte az Európai Unió 2020 első hónapjaiban a területére begyűrűző új típusú koronavírus-járványt, amely az uniós polgárok egészsége mellett az egységes belső piac megfelelő működését is komolyan veszélyeztetette. A kérdés azért érdemel alaposabb vizsgálatot, mert az Európai Unió az alapító szerződések rendelkezései alapján nem rendelkezik hatáskörrel kötelező erejű döntések meghozatalára „az emberi egészség védelme és javítása” terén, kizárólag támogató, összehangoló vagy kiegészítő intézkedések elfogadására. Ily módon szükségessé vált az alapító szerződések egységes piacra vonatkozó rendelkezéseinek oly módon történő újraértelmezése, hogy azok lehetővé tegyék a járványhelyzet kezelésével kapcsolatos tagállami intézkedések összehangolását, miközben az uniós intézmények maguk is komoly kihívásokkal szembesültek a döntéshozatali eljárásaik virtuális térbe helyezése kapcsán.
