Constitutional basis of family protection – Part I: Theoretical and historical funds

The study examines the constitutional foundations of the legal protection of family. As there are many interrelated causes of the marriage and family crisis, the study overviews them as well. It utilizes the research results of many other disciplines (biology, ethology, demography, psychology, sociology, history, economics). It examines the historical roots of the crisis, the still existing aftershocks, the same negative effects of Eastern collectivism and Western individualism. It addresses the problem of general value relativism, the social protection function of marriage and the family as foundation values. It touches on the complex toolbox of family protection and the dilemmas of legal protection.
