NEW RULES IN ENSURING UNIFORMITY OF JURISPRUDENCE: INTRODUCTION OF A LIMITED SYSTEM OF PRECEDENTS IN HUNGARY

Pursuant to Article 25(3) of the Hungarian Fundamental Law, the Curia has a priority task to ensure the unity of the application of the law by the courts. Because of this legal provision, the supreme judicial body is responsible for directing the application of the law and for establishing and maintaining legal unity. In order to accomplish this task, several tools are at its disposal, among which a significant change occurred in 2020, which the Hungarian literature refers to with the introduction of a limited system of precedents. The aim of this study is to define the basic content of this limited system of precedents and to contrast the views of the literature surrounding the introduction of this system.
