IMPORTANCE OF EXECUTION IN THE ADMINISTRATIVE PROCEDURE

Abstract

Modern social coexistence presumes the existence of norms that determine the means of conduct to be followed in different situations by its society members. Throughout the history of man, such norms increasingly take shape in the form of legislations. A basic requirement on any legislation is that it must fully fulfil the role intended for it, because if the whole or a part of any legislation should fail to be capable of fulfilling such a role, organised social coexistence itself may be exposed to dangers. Consequently, legislators must take several different aspects into consideration in the process of preparing legislations. One of such aspects is to ensure that legislations must include clear and understandable notions and terms, as law abiders can only be expected to ensure proper conduct upon such conditions. If this condition should fail to be met, it could easily lead to cases when people, without any fault, would act in an unlawful manner as a result of a disputable interpretation of a law. Nevertheless, legislators must reasonably expect that voluntary legal compliance does not always take place in every case.
