WORK WITH PRECARIOUS STATUS AND THEIR DIFFICULTIES OF ENFORCING LABOUR LAW PROTECTION IN HUNGARIAN LAW

Many forms of working with precarious status are known in jurisprudence, so that economically dependent self-employment is a regular subject of academic debate, but the most frequent discussion is about the substantive legal consequences of the status. However, an examination of the case-law suggests that it is not too much to say that procedural law circumstances have an extraordinary impact on the legal certainty of the status, which currently fails to take sufficient account of the vulnerable situation of the worker, pushing it towards precariousness. It is therefore important to be aware of the circumstances which could break the uniformity of enforcment of the law and which reinforce the vulnerability of workers in the fight for protection under employment law.
