Protection of historic monument as one of the pillars of institutional protection guarantees of fundamental right to a healthy environment

Abstract

Regulations concerning the protection of historic monuments are laid down in a separate chapter of the law on protection of cultural heritage year 2001 of LXIV. The protection of cultural heritage includes regulations on historic monuments, archeological heritage as well as cultural goods. The law on the protection of cultural heritage makes a distinction between the definition of historic monuments and historic monumental value. By looking at the two it can be stated that historic monumental value is a larger definition which includes historic monuments. By definition not all monumental value qualifies as historic monument, delimitation is based on declaration of protection.  The law on the protection of cultural heritage specifies the general tasks concerning historic monuments on the categories of monumental values, historic monuments and their surroundings as well as of education-research. In regards of monumental values the main tasks are their tracing, scientific research, evaluation and taking them into account, documentation, registration and declaration of protection. In my study, my primary aim is to present the changes in regards of the protection of historic monuments.
