Contracts with Deferred Payment in the Time of the Roman Republic

The aim of this paper is to show and legal analyse of the contracts with deferred payments from the 3rd and 2nd centuries B.C. My examination found three contracts from the field of public law and one from the field of private law. The contracts of the public law, one is a purchase contract (purchase of slaves) and two are lease and hire contracts (supply for the army and constructions of buildings), the private law example is a formula for selling of wine from the jar. Surprisingly we found not only in the public law, but also in the private law contracts free from any formality in this period. The major difference, that the deferred payment was used in the public law contracts an exceptional solution caused by the bad financial condition of the state treasury during the second Punic war. The private contractpartner could trust only in the benignity of the Roman State (bona fides). On the contrary, in the private law contracts the deferred payment was usual and here the payment was secured by the retention of the ownership of the sold thing.
