The accounts of the tax-farmers companies and the actio ad exhibendum

The aim of this paper is to show a tiny, but very interesting and until now hiding in the shadows part of the speach of Cicero against Verres, and that is the examination of a lawsuit, our present day’s definition: a suit for “access to public data”, in the Roman Law: a suit for producion of a thing (actio ad exhibendum). The short story is: Cicero during the preparation for the accusation against Verres collected some evidence and he reached the insight to the company of the publicans’s (tax-collectors) books, where he found some corrupt letters. After it, he brought a law-suit against of the keeper of the books of the company, namely Carpinatius, to show up these books for the public, i.e. for the publication of the data kept in them, for the purpose, to use them in the process in Rome as evidence, which aim was reached by him in this earlier process.
