The phenomenon of constitutional identity has been a subject of public law and political debates for decades regarding the relationship between the European Union and its member states. The present two-part study examines the role of constitutional identity through the example of three key founding member states: France, Germany and Italy. It highlights the evolution of the concept in the recent case law of the three respective constitutional courts (in France, the Constitutional Council) in a comparative approach. In the first part, after discussing the concept of constitutional identity, the hierarchy of norms and the supremacy of EU law is analysed, then the early decisions of the constitutional courts on constitutional identity serve as basis of comparison.
