Relation between the prosecution and the investigating authority in the initial stages of Serbian and Hungarian criminal proceedings

The study examines the relationship between the prosecutor and the police during the investigative phase of Serbian and Hungarian criminal proceedings. In addition to the constitutional status of the prosecutor's office, the leading role of the prosecutor in Serbian criminal procedure in the pre-trial phase of the investigation is presented. In Hungary, the actual powers of the prosecutor, which determine the basis of the relationship between the prosecutor's office and the investigating authority in the preliminary proceedings, the investigation, and the exploration, are described. The group of decisions to open an investigation and denunciation are highlighted. The summary contains the conclusions of the comparative analysis.
