Preliminary ruling proceedings initiated by the Miskolc Regional Court

Abstract

The preliminary ruling procedure allows courts in Member States to refer questions to the Court of Justice concerning the interpretation of EU law or the validity of an EU legal act in the context of a legal dispute before them. The frequency with which preliminary ruling proceedings are initiated is the result of individual judicial discretion, which depends on a number of factors and cannot be influenced in any way by administrative means. The aim of this study is to provide an overview of the preliminary ruling procedure of the European Court of Justice, with particular regard to preliminary ruling procedures initiated by the Miskolc Regional Court.
