Abstract

Interim measure is a long-established legal instrument and can also be used in proceedings before the Court of Justice of the European Union. However, a new trend has emerged in recent years. On the one hand, interim measures have been used in infringement proceedings and, on the other hand, the Court of Justice has imposed penalty payment on Member State in several cases in order to enforce them. The study examines these cases and draws conclusions from them.
