Abstract

Writing of this paper was inspired by the codification work of the International Law Commission of the United Nations General Assembly conducted on the field of protection of the environment during armed conflict. The aim of this paper is to point out the failures of effective treaties have in common. Namely, none of these treaties is applicable for environmental warfare during non-international armed conflicts, which strike more often nowadays than international ones, giving green light to many lacunas.
