Abstract

A well-functioning civil procedure is in common interest of both legal practitioners and the parties seeking justice. The application of the new Civil Procedure Code, the Act CXXX of 2016., has been in progress for several years. It is useful to analyze the initial difficulties in the application of the Code, as well as the critical points in the practical implementation of the Code and how legislators and judicial practitioners sought multiple solutions to promote enforcing substantive rights by reasonable adjustments of the regulation.
