Some thoughts on the issue of threatening to commit a crime with particular reference to threatening to commit a terrorist crime

Abstract

In the first part of the study, I examine the domestic legal history of threatening to commit a crime and the possible reasons for its criminalization. The second part is devoted to outline the relevant provisions of the Directive (EU) 2017/541 of the European Parliament and of the Council on combating terrorism and the statutory definition of crime of terrorism in Hungarian Criminal Code, in particular the criminal offence of threatening to commit a terrorist crime. Finally I analyse the domestic judicial practice, pointing out the contradictions in the decisions and I propose a possible new legislation.
