Responsibility for occupational health and safety in EU and Hungarian law

The addressee of occupational safety and health obligations is primarily the employer, who has an objective responsibility for complying with the rules. However, health and safety provisions cannot be implemented without the employees’ cooperation, so they also have certain obligations. The article reviews the parties’ responsibilities and their relationship to each other, highlighting why, even in extraordinary circumstances, the parties should not be able to deviate in an individual agreement from the rules of occupational health and safety.
