Theories on issues of judicial legislation and/or the application of law

Abstract

The principle and theoretical foundations that form the basis of the limited precedent system are not marginal from the point of view of how the unity of legislation and law application can be most optimally implemented. In this regard, there are three authors, Kelsen, Hart and Dworkin, whose theoretical work can be considered relevant among the authors of legal theory, and their domestic influence cannot be questioned. The three authors made substantive findings both in terms of legislation and law application.
