The aim of the present study is to compare the civil law rules of conventional representation with the rules of conventional representation in administrative proceedings along their subjective, material, substance, and formal elements. We seek to answer the question how the codified administrative procedure helps to enforce the right to representation, as a fundamental element of right to a fair trial. To this end, we compare the Hungarian legislation with the Romanian legislation, where the administrative procedure is not currently codified.
