Abstract

The Unfair Commercial Practices Directive (UCPD) is technology-neutral, i.e., it will apply to the various traders in the digital sector and online intermediaries. The provisions of the Hungarian law (Fttv.) also apply to infringements committed not only offline but also in the online environment. However, the particularities of the digital environment are also generating novel solutions in commercial practices, including unacceptable methods and techniques. To demonstrate this, we take a closer look at the Booking.com decision.
