Practical problems related to the serving of the order for payment with particular regard to the postal serving

In the procedure of order for payment under the jurisdiction of the notary, it is very common that the obligor does not accept the order for payment issued by the notary. Between September 25, 2023 and March 25, 2024, this case occurred in 37.6 percent (!) of the 619 order for payment cases received by notary Ajka No. 1. Within this, 83.3% of order for payments returned with the “unclaimed” ("nem kereste”) postmark, which is a surprisingly high number. Different procedural legal consequences are associated with the order for payments that have not been received, the purpose of this study is to present them.
