Abstract

Until 2026, three Member States – Slovakia, Hungary, and Slovenia, in the chronological order of their relevant constitutional amendments – have constitutionally recognised the right to pay in cash. The European Central Bank has adopted opinions raising concerns regarding compliance with EU law. As members of the eurozone, Slovakia and Slovenia have significantly less leeway concerning regulation related to the official currency compared to Hungary. However, the EU institution in question has not issued a decisively supportive statement in either case. In the absence of a reassuring response, this article explores the dilemmas surrounding this new fundamental right.
