In recent years, changes have taken place in the legal systems of the Member States of EU, which have brought new problems to the divorce of international couples. One such issue is private divorce, the so-called “out of court divorce” because several Member States of the European Union allow court proceedings to be avoided. However, the recognition of these divorces in another Member State could be a problem, as shown by the ongoing C-646/20 case before the Court of Justice of the European Union. The study details the answers given to these questions by EU law.
