Abstract

The study examines the implementation of ILO Convention No. 87 in Hungary in light of the 2025 observations of the Committee on the Application of Standards of the International Labour Conference. It explores whether the constitutional and labour law guarantees existing in the Hungarian legal system adequately ensure the free establishment, operation and representative activities of workers’ and employers’ organisations. The analysis addresses practical difficulties related to trade union registration, changes in the rules on membership fee deduction in the public sector, the impact of minimum service requirements on the right to strike, and the labour law limits of employees’ freedom of expression. The study concludes that Hungarian regulation formally contains several important guarantees; however, the effective exercise of collective rights depends on consistent legal application, the strengthening of a fundamental-rights-based approach, and meaningful dialogue with social partners.
