Present-day Roman law: possession disputes then and now

Abstract

This study is about the comparison of two notable possession disputes. In spite of the fact that more than two millennia passed between the two cases, we can still discover many similarities. The main reason for this, is that the Hungarian civil law – following the ancient Roman traditions – still considers the fact of possession as the principle of the possessory protection. Therefore, the historical-dogmatical origins can have an essential role in the remarkably diversified system of civil possession disputes.
