In my study, I examine the absolute reasons for the judge's disqualification based on the criminal procedure law. I will also deal with the case where a former judge (prosecutor) acts as a defense attorney in a criminal trial, and in connection with this, I will also review the effective regulation of this in the light of the practice of the Constitutional Court. I will also address the issue of the usability of the evidence taken by the disqualified judge, in connection with which the defense often raises objections.
